ARIANA GRANDE CHRISTMAS GIVEAWAY Terms & Conditions
1. Promoter’s name and address
1.1 The Promoter is SA Designer Parfums Limited, Amertrans Park, Bushey Mill Lane, Watford, Herts, WD24 7JG, United Kingdom (the “Promoter”).
2. The Competition
2.1 The title of the competition is Ariana Grande Christmas Giveaway (the “Competition”).
3. Start date
3.1 The Competition will run from when it is uploaded to Superdrug’s internal social channel (the “Hub”) on Tuesday 15th December 2020 (the “Competition Post”).
4. Closing date
4.1 The Competition will close at midnight on Thursday 17th December 2020 (the “Closing Date”).
4.2 All Competition entries must be received by the Promoter by no later than midnight on the Closing Date.
4.3 All Competition entries received after the Closing Date are automatically disqualified.
5. How to participate
5.1 In order to enter this Competition, prior to the Closing Date, participants will need to post a comment stating what their favourite Ariana Grande song is on the Competition Post.
5.2 For an entry to be valid, participants have to comply with all of the requirements detailed in clause 5.1 above.
5.3 No purchase is necessary and the Promoter makes no charge for entry to the Competition.
5.4 The Promoter will not accept:
(a) responsibility for Competition entries which are lost, mislaid, damaged, or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
(b) proof of transmission as proof of receipt of entry to the Competition.
5.5 By submitting a Competition entry, you are agreeing to be bound by these terms and conditions.
6. Eligibility
6.1 The Competition is open to all residents in the United Kingdom aged 16 years or over only, but at all times excluding:
(a) employees of the Promoter or its holding or subsidiary companies;
(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the Competition or its administration; or
(c) members of the immediate families or households of (a) and (b) above.
6.2 In entering the Competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the Competition.
6.3 The Promoter will not accept Competition entries which are:
(a) automatically generated by computer;
(b) completed by third parties or in bulk;
(c) illegible, have been altered, reconstructed, forged or tampered with;
(d) photocopies and not originals; or
(e) incomplete, misspelt, inaudible or incomprehensible.
6.4 There is a limit of one entry to this Competition per person. Entries over the maximum number of entries will be void and will not be entered into this Competition. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
6.5 The Promoter reserves all rights to disqualify you if your conduct is in bad faith and/or otherwise contrary to the spirit or intention of the Competition.
7. Selection of the winners
7.1 Three (3) winners will be selected at random performed by a random number generator computer process from all eligible entries received by the Promoter, which are submitted in accordance with these terms and conditions.
7.2 Unless the winner(s) notify the Promoter otherwise, the Promoter reserves the right to use and feature the (user) names of the winner(s) for publicity purposes and the winners agree that they will participate in any reasonable publicity arranged by the Promoter or its agencies.
7.3 Winners may be required to submit valid identification before receiving their prize.
8. Prize OR Prizes
8.1 Each of the three (3) winners will win the following:
1 x Ariana Grande Cloud 30ml Gift Set
1 x Ariana Grande Thank U, Next Eau de Parfum 50ml gift set
1 x R.E.M. by Ariana Grande Limited Edition Eau De Parfum 50ml
8.2 Prizes are subject to availability. There are no alternative prizes and no cash alternatives.
8.3 The prizes are non-transferable and exclude any additional costs and expenses.
8.4 The winners are responsible for all applicable taxes not specified in the description of the prizes above.
9. Notification of the results
9.1 The winners of the Competition will be announced by posting a reply to each winner’s comment on the Competition Post (the “Announcement”) on Friday 18th December 2020 (“Announcement Date”).
9.2 The Promoter will notify the winners of the Competition by posting the Announcement.
9.3 The Promoter will post a contact email address in the Announcement.
9.4 To claim the prizes, each winner is required to contact the Promoter at the email address provided in the Announcement with their full name and delivery address.
9.5 The decision of the Promoter is final and no correspondence or discussion will be entered into.
9.6 If any winner cannot be contacted or does not claim the prize within 14 days of notification, the Promoter reserves the right to withdraw the prize from the winner and pick a replacement winner.
9.7 Unless the Promoter receives an objection in accordance with condition 9.9 below, the Promoter will send the surname and County of residence of winners and, if applicable, their winning entries, to anyone who writes within one month after the Announcement Date requesting this information and enclosing a self-addressed envelope to the address set out in condition 1.
9.8 In the event you win a prize, you consent to the Promoter publishing or making available your surname, County of residence and, if applicable, winning entry, to anyone, unless you inform the Promoter of your objection in accordance with condition 9.9 below.
9.9 You have the right to object to the Promoter publishing or making available your surname, County of residence, and, if applicable, winning entry, and can do so by writing to the Promoter within one month after the Closing Date at the address set out in condition 1. The Promoter is nevertheless required to provide your information and winning entry to the Advertising Standards Authority (ASA) upon request.
10. General
10.1 Once you have submitted an entry, you acknowledge that the copyright in your entry will be owned by the Promoter.
10.2 Except in respect of death or personal injury caused by the Promoter’s negligence (or that of its agents or distributors), insofar as is permitted by law, the Promoter, its agents or distributors will not be responsible or liable to compensate the winner or accept any liability for any loss or damage occurring as a result of taking up the prize except where it is caused by the fraud of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
10.3 In the event of unforeseen circumstances or circumstances outside its reasonable control, the Promoter reserves the right to modify or discontinue, temporarily or permanently, this Competition without prior notice.
10.4 Promotions are in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or Instagram.
SA Designer Parfums Limited, Ariana Grande and, their respective promotional and advertising agencies, and all respective officers directors, employees, representatives and agents shall have no liability and shall be held harmless by winners for any damage, loss or liability to person or property, due in whole or part, directly or indirectly, by reason of the acceptance, possession, use or misuse of any prize or participation in this Competition. Any and all disputes, claims and causes of action arising out of or connected with this Competition, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration. Any and all claims, judgments and awards shall be limited to actual out-of- pocket costs incurred, including costs associated with entering this Competition, but in no event attorney's fees.
10.6 These terms and conditions shall be governed by and construed in accordance with the laws of England and any disputes shall be subject to the exclusive jurisdiction of the English Courts.
10.7 All personal data submitted in relation to this Competition shall be held and used by the Promoter in accordance with the Promoter’s Privacy Policy which can be found [here].
